Your use of this Site and our services, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Service, including its binding arbitration and dispute resolution provisions.

Information You Provide Directly

When you fill out a form, request a rent estimate, submit a contact inquiry, apply for a rental property, schedule a showing, or otherwise communicate with us, we may collect:

• Financial information: Bank account or payment information (processed securely through third-party payment processors; we do not store full financial account numbers)
• Application data: Employment history, income information, rental history, and other information relevant to a rental application

3. Consent to Communications (Email, Phone, and Text/SMS)

By submitting a form on our Site, requesting a rent estimate, or otherwise providing your contact information, you consent to be contacted by Allay Realty Group at the telephone number and/or email address you provided. This may include contact via live, recorded, artificial, or AI-generated voice, text message (SMS/MMS), automated dialing, pre-recorded messaging, and/or email, even if your telephone number is on a corporate, state, or the National Do Not Call Registry.

Consent is not a condition of purchase. You are not required to provide consent to receive calls or text messages as a condition of purchasing any property, goods, or services from Allay Realty Group. You may revoke consent at any time.

• To opt out of text messages: Reply "STOP" to any text message from us. You will receive a confirmation message and no further text messages will be sent.
• To opt out of voice calls: Tell the person on the line or reply to any message stating you no longer wish to receive calls.
• To opt out of marketing emails: Click "unsubscribe" in any email, or contact us directly at hello@allayresidential.com.

We will process all opt-out and revocation requests within 30 days of receipt.

Message and data rates may apply. Message frequency may vary. Carriers are not liable for delayed or undelivered messages. Your opt-in data will not be shared with third parties for promotional purposes.

4. How We Share Your Information

We do not sell your personal information. Data will not be sold or shared with third parties for their own promotional or marketing purposes. We may share your information with:

• Service providers who help us operate our business (property management software, screening services, email and communication platforms, payment processors, listing syndication partners)
• Property owners when relevant to a rental application or tenancy
• Affiliated business partners, including RE/MAX Metro Atlanta (under which Allay Realty Group operates), in support of the services you have requested
• Legal authorities when required by law, to comply with a subpoena or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud

5. Cookies, Tracking Technologies, and Analytics

Our Site uses cookies and similar tracking technologies to improve your experience and analyze Site usage. These may include:

• Analytics tools (such as Google Analytics) that collect information about how visitors use our Site, including pages visited, time spent, and traffic sources
• Advertising pixels (such as Google Ads and Facebook/Meta Pixel) that help us measure the effectiveness of our advertising and deliver relevant content
• Customer relationship management tools (such as Follow Up Boss) that help us manage communications and follow up on inquiries
• Third-party tools you are handed off to - our rental listings are served by us, but booking a tour or submitting an application opens RentEngine's own scheduling and application pages, which collect data under their privacy policy rather than ours

You can control cookie preferences through your browser settings. Disabling cookies may affect Site functionality.

Do Not Track Signals: Our Site does not currently respond to "Do Not Track" browser signals. When you use our Site, other parties cannot collect personally identifiable information about your online activities over time and across different websites unless you voluntarily submit that information through a form.

6. Third-Party Websites, Widgets, and Embeds

Our Site includes links to and embeds from third-party services, including our property management portal (Rentvine), our tour-scheduling and application platform (RentEngine), and listing syndication partners (Zillow, Apartments.com, and others). Information collected by these third-party services is governed by their own privacy policies, not ours. 8. Special Notice to California Residents

You will need to provide sufficient information for us to verify your identity (such as the name, email address, phone number, or property address associated with your interaction with us). We will respond to verifiable requests within 45 days of receipt. If we need additional time, we will notify you of the extension and the reason for it.

You may also designate an authorized agent to make a request on your behalf. We may require the agent to provide proof of authorization and may still verify your identity directly.

9. Data Retention

We retain your personal information for as long as we have a legitimate business purpose for doing so, including to provide our services, maintain business records, comply with legal and regulatory obligations, resolve disputes, and enforce our agreements. This means we may retain your information indefinitely unless you request deletion.

• Inquiry and lead data (rent estimates, contact form submissions): Retained for the duration of any business relationship and afterward as part of our business records.
• Rental application data: Retained for the duration of the tenancy and afterward as required by applicable law and our record-keeping practices.
• Financial and transaction records: Retained as required by tax and accounting regulations and our business record-keeping practices.
• Website usage data and cookies: Retention periods vary by platform (for example, Google Analytics data is retained for up to 26 months).

If you would like us to delete your personal information, you may submit a request as described in Section 7 (Your Rights and Choices) or Section 8 (Special Notice to California Residents). We will honor deletion requests to the extent permitted by law, though we may retain certain information where we have a legal obligation or legitimate need to do so (such as financial records required for tax compliance).

We may retain de-identified or aggregated data that can no longer reasonably identify you for analytical and business purposes.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. By using our services, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Privacy Policy.

We may update this Privacy Policy from time to time to reflect changes to our information practices or changes in applicable regulations. Changes will be posted on this page with an updated effective date.
